1. Agreement to these Terms
These Terms of Service ("Terms") are a legal agreement between you and ICTX Enterprises LLC ("ICTX," "we," "us," or "our"), the operator of iccosmos.com and pages that link to these Terms (collectively, the "Site"). The Site presents information about the author I. C. Cosmos and her books, offers an email newsletter, and links to third-party retailers and platforms.
By accessing or using the Site, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Site. If you use the Site on behalf of an organization, you warrant that you have authority to bind that organization, and "you" includes the organization.
2. Eligibility
You must be at least 13 years old to use the Site. If you are under the age of legal majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian. The Site is not directed to children under 13.
3. Changes to the Site or these Terms
We may update the Site and these Terms from time to time. The effective date above shows when these Terms were last revised. Material changes will apply prospectively, and we will provide additional notice when required by law. Your continued use after revised Terms take effect constitutes acceptance of the revised Terms. If you do not agree to a revision, stop using the Site.
4. Limited permission to use the Site
Subject to these Terms, ICTX grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable permission to access and use the Site and its publicly available content for personal, noncommercial purposes. This permission does not transfer any ownership rights.
5. Intellectual property
The Site and its content—including text, book descriptions and excerpts, photographs, artwork, cover images, graphics, logos, page design, audio, video, downloads, and software (collectively, "Content")—are owned by ICTX, the author, or their respective licensors and are protected by copyright, trademark, and other laws.
Except for the limited permission in Section 4 or as permitted by applicable law, you may not reproduce, distribute, publicly display, publicly perform, publish, adapt, translate, create derivative works from, sell, license, or commercially exploit the Site or Content without prior written permission from the applicable rights holder. You may share an unmodified link to a publicly available Site page.
- C. Cosmos, associated logos, book and series branding, and other source identifiers displayed on the Site may be trademarks or protected trade dress. No license to use them is granted except as necessary to identify the Site when sharing a lawful link.
6. Prohibited conduct
You agree not to:
- Use the Site or Content in violation of law or the rights of another person.
- Circumvent access controls, probe or test vulnerabilities without written authorization, introduce malicious code, or interfere with Site operation or another person's use.
- Impersonate another person, misrepresent an affiliation, or submit false or misleading information.
- Harvest personal information, send spam, or use the Site to facilitate harassment, fraud, infringement, or other harmful conduct.
- Use automated means to access, scrape, copy, or index the Site in a manner that imposes an unreasonable burden or violates instructions in robots.txt, except for ordinary indexing by a generally available search engine.
- Use substantial portions of the Content to train, develop, benchmark, or improve an artificial-intelligence or machine-learning model without prior written permission, except to the extent applicable law expressly prevents this restriction.
- Remove or alter copyright, trademark, attribution, or other proprietary notices.
7. Communications, feedback, and submissions
If you send us feedback, comments, reviews, photographs, contest entries, or other material (a "Submission"), you retain any ownership rights you have. You grant ICTX a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, format, edit for length or clarity, display, distribute, and promote the Submission in connection with the Site, the author, and the author's books. This license lasts for as long as reasonably necessary for those purposes, including continued use in materials created before you request removal. Where permitted by law, you waive or agree not to assert moral rights to the extent needed for these uses.
You represent that you have the rights needed to provide the Submission; that it is accurate to the best of your knowledge; and that our permitted use will not violate another person's intellectual-property, privacy, publicity, contractual, or other rights. Do not submit confidential information. We are not required to publish or retain a Submission and may remove it at any time.
8. Newsletter and electronic communications
If you subscribe to the newsletter, you request and consent to receive email communications about the author, books, reading recommendations, and related topics. You may unsubscribe at any time using the link in an email. Newsletter signup and handling of personal information are also governed by our Privacy Policy.
You agree that notices and communications may be provided electronically, including by posting on the Site or sending email to an address you provide, to the extent permitted by law.
9. Third-party links, retailers, and purchases
The Site may link to Amazon, BookBub, social networks, booksellers, and other third-party sites. These links are provided for convenience and do not place the third party under ICTX's control. A third party's terms, privacy policy, pricing, availability, delivery, refund rules, and customer-service practices govern your interaction with that party.
Unless a Site page expressly states otherwise, ICTX does not sell books, subscriptions, memberships, or other products directly through the Site and does not collect payment-card information. A purchase made after following a retailer link is between you and the retailer. ICTX is not responsible for a third party's content, products, services, availability, acts, or omissions.
10. Affiliate links and material connections
Some links or recommendations may be affiliate links or may involve another material connection. If you click an affiliate link or make a purchase, ICTX may receive a commission or other benefit without increasing your price. Where required, we will provide a clear disclosure near the relevant recommendation or link. Compensation does not change our commitment to express honest opinions based on information reasonably available to us.
11. Reviews and testimonials
Reviews, ratings, quotations, and testimonials reflect the views and experiences of their authors. Individual opinions and experiences vary. We may edit a quotation for length, spelling, or clarity without intentionally changing its meaning. We do not guarantee that you will share a reviewer's opinion or experience.
12. Informational and fictional content
The Site is provided for informational, promotional, and entertainment purposes. It is not legal, medical, financial, cybersecurity, mental-health, or other professional advice. Book plots, characters, settings, and promotional descriptions may involve fictional or dramatized events. You are responsible for your decisions and for obtaining professional advice when appropriate.
13. Copyright concerns
If you believe material on the Site infringes your copyright, email support@ictxenterprises.com with: your contact information; identification of the copyrighted work; the exact URL and description of the material at issue; a statement explaining your good-faith belief that the use is unauthorized; a statement that the information supplied is accurate and that you are authorized to act; and your physical or electronic signature. We may remove or restrict material while reviewing a notice. This section does not represent that ICTX qualifies for any statutory safe harbor or has appointed a registered DMCA agent.
14. Site availability and changes
We may change, suspend, restrict, or discontinue any part of the Site at any time. We do not guarantee that the Site or any Content will remain available, error-free, secure, or compatible with every device. We may correct errors and update Content without notice.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." ICTX AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AUTHORS, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT CONTENT IS COMPLETE OR CURRENT, OR THAT THE SITE OR ITS SERVERS ARE FREE OF HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICTX AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AUTHORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR COSTS OF SUBSTITUTE SERVICES ARISING FROM OR RELATED TO THE SITE, CONTENT, OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE, CONTENT, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID DIRECTLY TO ICTX THROUGH THE SITE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations apply regardless of the form of action and to the fullest extent permitted by law. They do not limit liability that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits limitation. Your non-waivable consumer rights remain in effect.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless ICTX and its members, managers, officers, employees, agents, affiliates, authors, and licensors from third-party claims, losses, liabilities, judgments, damages, and reasonable legal fees arising from your unlawful or willful misuse of the Site, your material breach of these Terms, or a Submission that violates another person's rights. This obligation does not apply to the extent a claim results from the indemnified party's own negligence, willful misconduct, or violation of law. We may control the defense of a covered claim, and you agree to provide reasonable cooperation. You may not settle a claim in a manner that admits fault by or imposes obligations on an indemnified party without written consent.
18. Suspension and termination
We may suspend or terminate your access to the Site if we reasonably believe you violated these Terms, created a security or legal risk, or misused the Site. You may stop using the Site at any time. Provisions that by their nature should survive termination—including intellectual-property, disclaimers, liability limitations, indemnification, dispute, and miscellaneous provisions—will survive.
19. Governing law and Maryland courts
These Terms and any dispute arising from or related to the Site or Content are governed by the laws of the State of Maryland, without regard to conflict-of-laws principles, except to the extent federal law applies. Nothing in these Terms deprives you of mandatory consumer protections that cannot be waived under the law of your residence.
Before filing a lawsuit, the complaining party will send the other party a written description of the dispute and requested relief and allow thirty days for a good-faith effort to resolve it, unless immediate relief is reasonably necessary or a limitations period would expire. Notices to ICTX must be sent to support@ictxenterprises.com.
Any lawsuit arising from or related to the Site, Content, or these Terms must be brought in a state or federal court of competent jurisdiction located in Maryland. You and ICTX consent to the personal jurisdiction of those courts. There is no agreement in these Terms requiring arbitration.
20. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement concerning your use of the Site, except that additional written terms may apply to a specific promotion or service.
- Severability. If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective.
- No waiver. A failure to enforce a provision is not a waiver of the right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. ICTX may assign them in connection with a merger, reorganization, sale of assets, or by operation of law.
- Force majeure. ICTX is not responsible for delay or failure caused by events beyond its reasonable control, including outages, cyberattacks, labor disputes, natural disasters, war, government action, or failure of third-party infrastructure.
- No agency. These Terms do not create an employment, partnership, joint venture, fiduciary, franchise, or agency relationship between you and ICTX.
- Headings. Headings are for convenience and do not affect interpretation.
